1. A Customer who is a Consumer and has concluded a Sales Agreement may withdraw from it in accordance with the rules set out below. The right of withdrawal depends on the type of Goods ordered:
a) Goods available for immediate dispatch (held in stock) – the Customer may withdraw from the Sales Agreement:
- within 14 days – without giving any reason, or
- within 60 days – by giving a reason, provided that the Customer was a registered user when placing the order.
b) Personalised Goods (made to order / manufactured to the Customer’s specifications) – the Customer does not have the right to withdraw from the Sales Agreement if the Goods are non-prefabricated items manufactured according to the Customer’s specifications or intended to meet the Customer’s individual needs, in accordance with Article 38(3) of the Polish Consumer Rights Act.
2. In the case of upholstered furniture, Personalised Goods include in particular furniture made to an individual order, for which the Customer selects specific product features, such as the fabric and/or fabric colour from the available range, configuration, corner orientation or finishing elements. For the avoidance of doubt, selecting a fabric from a wide range of available fabrics also constitutes personalisation, as the furniture is manufactured according to the Customer’s specific choice.
3. Where an order includes both Personalised Goods and Goods available for immediate dispatch (held in stock), the right of withdrawal applies only to the part of the order concerning Goods available for immediate dispatch (held in stock).
4. The withdrawal period for Goods available for immediate dispatch begins when the Customer takes possession of the Goods. The Customer may withdraw from the Sales Agreement by submitting a withdrawal statement to the Seller.
5. The withdrawal statement may be submitted using the form provided by the Seller on the Store Website at: Returns Form.
The completed returns form should be sent to: sklep@i-sofa.pl.
Please attach photographs if you have identified an issue with the furniture, such as a defect, damage, staining or non-conformity. This will help us verify and process your request more quickly.
To meet the deadline, it is sufficient to send the withdrawal statement before the withdrawal period expires.
6. In the event of withdrawal from the Sales Agreement, the Agreement shall be regarded as not having been concluded.
7. If the Customer submits a withdrawal statement before the Seller has accepted the Customer’s offer, the offer shall cease to be binding.
8. The Seller shall immediately, and no later than within 14 days of receiving the Customer’s statement of withdrawal from the Sales Agreement, refund all payments made by the Customer, including the cost of delivering the Goods to the Customer. The Seller may withhold the refund until the Goods have been returned or the Customer has provided proof that the Goods have been dispatched, whichever occurs first.
9. If the Customer exercising the right of withdrawal selected a delivery method other than the least expensive standard Delivery method offered by the Seller, the Seller is not required to reimburse the Customer for any additional costs incurred.
10. The Customer shall return the Goods to the Seller without undue delay and no later than within 14 days of the date on which the Customer withdrew from the Sales Agreement. To meet the deadline, it is sufficient to dispatch the Goods to the Seller’s address before the deadline expires.
11. In the event of withdrawal from the Sales Agreement, the Customer shall bear the direct cost of returning the Goods to the Seller’s warehouse.
12. If, due to their nature, the Goods cannot normally be returned by post, the Seller shall inform the Customer of the return costs on the Store Website.
13. Conditions for accepting a return
a) A return following withdrawal from the Sales Agreement applies to Goods available for immediate dispatch and is possible provided that the Goods are returned in an undamaged condition, without signs of use, stains, damage, odours or other evidence of use beyond what is necessary to establish the nature, characteristics and functionality of the Goods.
b) The Goods should be returned complete and properly secured for transport. We recommend using the original packaging or replacement packaging providing an equivalent level of protection.
c) The Customer shall bear the cost of returning the Goods.
d) The Goods must arrive at the Seller’s warehouse in an undamaged condition. If the Goods, including furniture, have been used or show signs of use, the Seller may refuse to accept the return under the right of withdrawal or may reduce the refund accordingly, in proportion to the reduction in the value of the Goods.
14. The Seller shall issue the refund using the same payment method used by the Customer, unless the Customer has expressly agreed to another refund method that does not involve any additional costs.
